Affidavit is a written Statement in which Deponent oath or Affirmation his/her Statement. Just like earlier people used to take oath in front of god OR also we can consider the example of Courts by taking swear of Bhagwat Geeta. Affidavit generally states that everything is true and correct and affiant sign the Affidavit by taking an Oath.

 If talking about the Courts then the Definition of Affidavit slightly varies. In Indian Law, an affidavit cannot ordinarily be used as evidence in absence of a specific order of the Court. It was held by the Supreme Court that an affidavit can be used as evidence only if the Court so orders for sufficient reasons.

HOW TO MAKE AFFIDAVIT?

STEP 1– Give the Title AFFIDAVIT in the Centre of the Page.

STEP 2– After that Mention the Details of the Deponent/Affiant that is Full Name, Father’s/Husband Name and Address and statement of affirmation.STEP 3– After that describe the Statement/facts as per the purpose of making an Affidavit in the Numbered list for ex: –

• That I am an Indian Citizen.
• That my Date of Birth is….
• That I am enclosing the Documents with the Affidavit.

STEP 4– After that Write the Statement of the Truth and Mention the Date and Signature Block like-

I hereby declare that whatever has been stated above is true to the best of my knowledge, correct and nothing material has been concealed there from.

STEP 5– Insert the Notary/Officer (Attestation Block). 

VERIFICATION: –
Verified at Bangalore on ……. (date) day of …………………… (name of day) 2019 that the contents of the above affidavit are true and correct to the best of my knowledge and belief.

That’s it! Your affidavit is ready now, now purchase the relevant stamp paper for it, sign at the place of deponent and make it attest.
